1. Acceptance of Terms
By accessing and using SmartAira (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. This Service is operated by and intended for use within the Republic of Indonesia. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.
2. Geographic Restriction
This Service is exclusively intended for users located within the Republic of Indonesia. The Service is not available to users outside Indonesia. By using this Service, you represent and warrant that you are physically located within Indonesia and have the legal authority to use the Service under Indonesian law.
3. Service Description
SmartAira provides AI-powered legal intelligence and meeting analysis services, including but not limited to: • Meeting transcription and analysis • Speaker identification and diarization • Regulation extraction and compliance monitoring • AI-powered chat functionality for meeting insights • Summary and recommendation generation • Document and material management The Service is designed specifically for Indonesian government institutions, legal professionals, and corporate entities requiring regulatory compliance monitoring.
4. User Eligibility
You must be authorized by your organization (typically a government institution, legal entity, or corporate entity within Indonesia) to use this Service. Access is granted based on organizational membership. By using the Service, you confirm that you have the necessary authorization from your organization.
5. Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to: • Keep your password secure and confidential • Notify us immediately of any unauthorized access • Accept responsibility for all activities under your account • Not share your account with others • Enable two-factor authentication when available
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to: • Violate any Indonesian laws or regulations • Upload or transmit malicious code or viruses • Attempt to gain unauthorized access to the Service • Interfere with or disrupt the Service • Use the Service for any illegal or unauthorized purpose • Share confidential information without proper authorization • Reverse engineer or attempt to extract source code • Use the Service to harass, abuse, or harm others
7. Data Processing and Confidentiality
All meeting data, transcripts, and related information processed through the Service are treated as confidential. We implement appropriate technical and organizational measures to protect your data in accordance with Indonesian data protection regulations (UU No. 27 Tahun 2022 tentang Pelindungan Data Pribadi). All access to the system is logged for security and audit purposes.
8. Voice Biometrics and Speaker Identification
The Service may use voice biometric technology for speaker identification purposes. By enrolling voice profiles or using speaker identification features, you consent to the processing of voice biometric data. Voice prints are stored securely and used solely for the purpose of improving meeting transcription accuracy and speaker identification.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by the Service provider and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. AI-generated content (summaries, recommendations, regulation extractions) is provided as a service to assist your work, but you retain ownership of your original meeting data, transcripts, and uploaded materials.
10. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate summaries, recommendations, extract regulations, and provide insights. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for verifying all important information, particularly legal and regulatory references, before relying on them for decision-making. The Service provider is not liable for decisions made based on AI-generated content.
11. Recording and Transcription
When recording meetings or conversations, you are responsible for: • Obtaining necessary consent from all participants • Complying with Indonesian recording laws and regulations • Informing participants that recordings are being made • Using recordings in accordance with applicable privacy laws The Service provider is not responsible for ensuring you have obtained proper consent for recordings.
12. Service Availability
We strive to maintain the Service's availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
13. Subscription and Payment
Access to the Service may require a subscription or payment. If applicable: • Fees are charged in Indonesian Rupiah (IDR) • Payment terms are specified in your organization's agreement • Subscription fees are non-refundable except as required by law • We reserve the right to modify pricing with advance notice • Failure to pay may result in service suspension
14. Limitation of Liability
To the maximum extent permitted by Indonesian law, the Service provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
15. Indemnification
You agree to defend, indemnify, and hold harmless the Service provider and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any dispute arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the Indonesian courts. The parties agree to attempt good-faith negotiations before commencing formal legal proceedings.
17. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes through: • In-app notifications • Email to your registered address • Notice on the login page Continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
18. Termination
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for: • Breach of these Terms • Suspected fraudulent or illegal activity • Failure to pay subscription fees • Request from your organization Upon termination, your right to use the Service ceases immediately, but data retention policies will continue to apply.

20. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
